These Terms of Service ("Terms") govern your access to and use of the Aucty platform, including our website at aucty.io, our mobile applications, and all related services (collectively, the "Service"). Aucty is operated by Aucty, Inc. ("Aucty," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. Please read them carefully.
By creating an account, accessing, or using Aucty in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.
You must be at least 18 years of age to use Aucty. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree with any part of these Terms, you must not access or use the Service.
To access certain features of the Service, you must create an account. When registering, you agree to the following:
You may not assign or transfer your account to any other person or entity without prior written consent from Aucty.
Aucty provides an online marketplace platform that connects content creators ("Creators" or "Sellers") with buyers ("Buyers"). Through Aucty, Creators can list physical items for auction and offer 1-on-1 video calls as purchasable experiences.
Aucty is a platform, not a party to transactions. We facilitate connections between Buyers and Sellers but are not a party to any transaction between them. Aucty does not own, possess, inspect, or control any items listed on the platform. We do not guarantee the quality, safety, legality, or accuracy of any listing, and we are not responsible for the performance of any Creator or Buyer obligation.
All transactions are between the Buyer and the Creator. Aucty acts solely as an intermediary that provides the technology, payment processing, and support infrastructure to facilitate these transactions.
Bidding on Aucty is subject to the following rules, which all users must follow:
When an auction concludes, the winning Buyer is automatically charged the final bid amount via their saved payment method. No additional action is required by the winning bidder to complete the purchase.
Aucty does not store your full credit card details. All payment information is handled and encrypted by Stripe in compliance with PCI-DSS standards.
For every completed transaction on the Aucty platform, the revenue from the final sale price is divided as follows:
Creator payouts are processed via Stripe Connect. To receive payouts, Creators must complete the Stripe Connect onboarding process, which includes identity verification and providing valid banking information. Payouts are initiated after the Buyer confirms receipt of the item or after the applicable delivery confirmation window has elapsed, whichever comes first.
Aucty reserves the right to modify the revenue split with 60 days' prior written notice to affected Creators. Any changes will apply only to transactions completed after the effective date of the change.
Creators who list items or offer 1-on-1 calls on Aucty agree to the following obligations:
Aucty is committed to providing a safe and trustworthy marketplace for Buyers. The following protections apply to all purchases made through the platform:
To file a dispute, contact our support team at support@aucty.app with your order number, a description of the issue, and any supporting photos or documentation. Our trust and safety team will respond within 48 hours.
You agree not to engage in any of the following prohibited activities while using Aucty:
Violation of any of these prohibitions may result in immediate account suspension or permanent termination, forfeiture of pending payouts, and referral to law enforcement where appropriate.
Your content. Users retain all ownership rights to the content they create and post on Aucty, including listing photos, descriptions, videos, and profile information ("User Content"). By posting User Content on Aucty, you grant Aucty a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content solely in connection with operating, promoting, and improving the Service. This license ends when you delete your content or your account, except where your content has been shared with others who have not deleted it.
Aucty's intellectual property. The Aucty name, logo, brand mark, and all associated branding elements are trademarks of Aucty, Inc. The Service, including its design, architecture, source code, algorithms, and underlying technology, is the proprietary property of Aucty, Inc. and is protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Service without our express written permission.
DMCA. If you believe your copyrighted work has been infringed on Aucty, please notify us at support@aucty.app with a complete DMCA takedown notice. We will respond to valid notices in accordance with the Digital Millennium Copyright Act.
Aucty is a marketplace platform that facilitates transactions between Buyers and Creators. To the maximum extent permitted by applicable law:
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Aucty does not warrant that the Service will be uninterrupted, error-free, or secure.
Aucty reserves the right to suspend, restrict, or permanently terminate your account and access to the Service at any time, with or without prior notice, for any reason, including but not limited to:
Voluntary account deletion. You may delete your account at any time through your account settings within the app, or by sending a written request to support@aucty.app. Upon account deletion, your profile and listings will be removed from the platform. However, certain information may be retained as required by law or for legitimate business purposes, such as fraud prevention and compliance with legal obligations.
Any pending transactions at the time of termination must still be completed. Outstanding payouts owed to Creators will be processed according to the normal payout schedule, provided no violations have been identified in connection with those transactions.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator, and judgment on the award may be entered in any court having jurisdiction.
Class action waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Aucty. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
Governing law. These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Travis County, Texas.
Informal resolution. Before initiating arbitration, you agree to first contact Aucty at support@aucty.app and attempt to resolve the dispute informally for at least 30 days. Most disputes can be resolved without the need for formal proceedings.
Aucty reserves the right to modify, update, or replace these Terms of Service at any time. When we make material changes, we will provide you with at least 30 days' prior notice through one or more of the following methods:
Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Service and delete your account before the changes take effect.
